The following Rules and Regulations have been established to ensure an enjoyable and safe vacation experience for all Members and Guests of the Club Cascadas de Baja resort. These rules apply to all members, their families, guests, and invitees and are enforced by the Board of Directors, the resort management, or the managing agent.
Pursuant to the Bylaws of the Cascadas de Baja Association, the Board of Directors may adopt, publish, and enforce Rules and Regulations related to the possession, use, and enjoyment of Club-maintained property.
Definitions
All definitions found in the Cascadas de Baja Association Bylaws apply here. Terms not defined therein may be defined within these rules.
These Rules and Regulations apply to each member and each occupant, including exchange users.
Violations
Members are expected to ensure full compliance with these Rules and Regulations by all occupants of their villa.
Violations should be reported promptly to the Front Desk, who will initiate appropriate corrective action.
Maximum Occupancy
- 1 Bedroom: Up to 4 guests
- 2 Bedroom: Up to 6 guests
- 3 Bedroom: Up to 8 guests
- 4 Bedroom: Up to 10 guests
Please note: A $50 per day fee will be charged for each guest over the maximum occupancy limit.
Care of Interior Furnishings & Equipment
- Report any damage to the Front Desk immediately to avoid charges.
- Occupants are responsible for any damage beyond normal wear and tear.
- Severe negligence may result in fines, suspension of privileges, loss of voting rights, or all the above.
- All personal belongings must be removed at check-out; unclaimed items will be considered abandoned.
- Maintain villas in a clean and sanitary condition; clean spills promptly to prevent ants.
- Do not remove any blankets, linens, towels, or kitchen items from the villa.
- Guests are responsible for loss or damage; report issues to the Front Desk immediately.
- A $150 cleaning fee will be charged if the villa is left in an unacceptable condition.
- All fines must be paid at check-out.
Quiet Hours
- Daily Quiet Hours: 10:00 p.m. – 6:30 a.m.
- Radios and stereos require headsets on the beach and in common areas.
- Excessive noise complaints will result in:
- First warning
- $100 fine
- $300 fine + police involvement after a third violation
Common Areas
- Outdoor furniture and equipment must remain in designated areas.
- Damage caused by a member, family, or guests will be billed to the member.
Beaches
- Beaches are public; guests are advised not to walk alone and to walk toward town (west).
- Outside food and beverages are prohibited in common areas except those purchased from the restaurant or bar.
Use of Pools & Spas
- Pool and spa hours: until 10:00 p.m.
- Private villa pools/spas may be used until 11:00 p.m.
- Members and guests use pools/spas at their own risk.
- No stereos at the beach or pool unless earphones are used.
- Loud noise is prohibited.
- Food and beverages consumed on the beach or in or around a common area pool must be purchased from a restaurant or bar on the property.
Fitness Center
- Open 6:00 a.m. – 8:00 p.m.
- Children under 12 are not allowed in the Fitness Center.
- Proper attire is required.
- Consult a physician before exercising.
Tennis Courts
- Tennis shoes only; no street shoes.
- Limit play to one set or one hour when others are waiting.
- Children under 14 must yield to adults if demand is high.
- Only water is allowed on courts.
Cabo San Lucas Local Regulations
Violations may result in arrest. Examples include:
- Public drinking
- Driving under the influence
- Public urination
- Disturbing the peace
- Immoral acts in public
- Excessive noise
- Littering
Traffic fines may be issued for parking violations.
Important:
- Carry ID and license when driving.
- Police officers are not allowed to accept money directly.
- Fines are paid only at official offices.
Reservation & Use Rights
- Each membership grants occupancy of a specific villa for a fixed Use Period of one week, Thursday-to-Thursday.
- No member may use a villa if delinquent in financial obligations.
Maintenance Fees
- Due January 1 each year.
- Late payments incur a 25% late charge.
- Delinquency may result in suspension of reservation and voting rights until paid in full.
Exchanging
- All financial obligations must be paid before exchanging weeks.
- Exchanging future weeks requires prepayment of the future maintenance fee.
Carryover
- Unused Use Weeks cannot be carried over through the Club.
- Weeks may be carried over through exchange companies following their procedures.
53rd Week
- Occurs when the Use Calendar contains an extra week.
- Week 52 and Week 1 owners have first option to rent Week 53 at a Board-approved rate.
- Remaining weeks open to other members, then the general public.
Personal Service Requests
Staff may not perform personal services during work hours.
Report villa or common-area issues to the Front Desk or Resort Manager.
Complaints
Submit complaints or suggestions to the Resort Manager or Board of Directors via Vacation Resorts International or email: Info@ClubCascadas.com.
Controlling Law & Jurisdiction
All services and facilities are provided in Baja California Sur, Mexico.
Use of the Resort constitutes acceptance of Mexican law and exclusive jurisdiction of local courts.
